Employement Contract, origin and termination of employment

  • The working relationship is established on the basis of a work contract or of appointment. Before signing an employment contract, the employer is obliged to inform the natural person about rights and responsibilities, which follows for him under the contract of employment, and about working conditions and remuneration conditions under which the work is to take place.
  • In the contract, the employer is obliged to arrange with the employee the type of work for which the employee is accepted, the place or places of work and a day of starting work.
  • Employment starts on the date that has been agreed in the employment contract as the day of starting work. If the employee does not start to work on agreed day unless some obstacle, the employer may terminate the employment contract.
  • Employment lasts indefinitely, unless explicitly agreed its duration. The duration of the employment relationship between the same parties on fixed-term contracts can be negotiated for a total maximum period of three years from the date of this working relationship and repeat the negotiation of employment or extension no more than twice;
  • If the probationary period is agreed, it may not be longer than 3 consecutive months from the date of commencement of employment, and in the case of the head no longer than six months. It can be arranged at least at the day, which was agreed as the date of commencement of employment. The trial period must be agreed in writing to be valid.
  • Employment may be terminated by agreement, notice, immediate termination or termination during the probationary period. Employment contracted for a fixed period ends with the expiry of the agreed period.
  • Both, employer and the employee may terminate the employment relationship by a notice. The notice must be in writing. The reason for termination cannot be changed afterwards.
  • The notice period shall be the same for both employers and employees and not less than two months. The notice period begins on the first day of the calendar month following receipt of notice.
  • In the trial period, both the employer and the employee can terminate the employment relationship for any reason or for no reason. Termination of employment during the probationary period must be made in writing. Employment will end on receipt of the cancellation, unless it specifies a later date.
  • Employment of foreigners and natural people without citizenship, if his termination is not make otherwise, expire on the date which is to end their stay in the Czech Republic.
Working hours

Working time is 40 hours per week, while its length depends on the nature of the workplace and age of employees.

It is provided that the length of working hours:
  • working underground in mining coal, ores and industrial minerals, in mining construction and mining sites of geological exploration is 37.5 hours a week;
  • with a continuous three-shift work mode is 37.5 hours a week;
  • a two-shift work mode is 38.75 hours per week;
  • for employees under 18 years must shift length on individual days exceed 8 hours when operating in a more fundamental labor relations, not weekly working time in its aggregate, exceed 40 hours per week.

The leave assessment is at least 4 weeks in a calendar year. The employees of employers who do not conduct business activities are entitled to the leave of five weeks. About specified period of leave, the employee must be notified by the employer at least 14 days in advance, unless they agree to a shorter period.
During the leave the employee is entitled to compensation wage in the amount of his average monthly earnings.
The employer must determine to employees take a leave as they could take holiday in the calendar year in which it is entitled to, unless the obstacles or urgent operational reasons.
The employee wage compensation for unused vacation is possible only in the event of termination of employment.

Wage and wage scales

The staff includes wage for their work, which may not be less than the minimum wage. For these purposes the wage does not include wages for overtime work, for work in difficult and hazardous work environments, work at night and work on public holidays and for work at night and on Sundays.

Salary is payable upon execution of the work, and no later than the calendar month following the month in which the employee was entitled to wages or any of its part. Within this period, the employer should determine the regular payday. Wages are paid during working hours and workplace, unless agreed other time and place of payment. When monthly bills wages the employer must give the employee a written document containing information about the individual components of wages and deductions made.

Minimum wage
As the lowest possible wage is announced by a government and published in the Official Gazette (now the Government Decree no. 567/2006 Coll., Hereinafter referred to as Reg. L.). 1. 1. 2015 for salaried employees monthly wage is 9,200 CZK (weekly working time of 40 hours) for salaried employees an hourly wage amounts to CZK 55.00 / hour.

Premiums for general health insurance

  • with the employer 9% of the assessment base (the employer pays for the employee)
  • for employees is 4.5% of the assessment base (paid by the employee in the form of payroll deductions made by the employer)
  • for the self-employed is 13.5% of the assessment base
  • for a person who for the entire calendar month no income from employment, self-employment, even for her, the premium payer is the state with 13.5% of the minimum wage
The insurance payer is obliged itself to calculate the appropriate amount of the premium and the amount to the account of the health insurance company.
